KPKB Lawyers Win Halt, Damages, In Tile-Cutter Patent Infringement
DORAL, Fla.—A South Florida Federal District Court ruled against an American importer, stating it had infringed on the patent and trademarks of Germans Boada, a leading international maker of tile-cutting tools used in construction.
The ruling enjoined further infringement and awarded $500,000 in damages.
“U.S. Patents are important assets that are protected from infringement by severe legal penalties,” said Jorge Espinosa of KPKB, legal counsel for Germans Boada.
The Barcelona-based company, which first began selling its products in the U.S. in 1982, created a subsidiary, Rubi Tools, headquartered in Doral, Fla., that had been its sole U.S. distributor since 1988.
KPKB convinced the court that American Sunshine Import & Export, Inc., a U.S. reseller of tile-cutting products, had infringed on a key Germans Boada design patent and its Rubi Tools registered trademarks.
In addition to the damages, American Sunshine faced legal fees and court costs.
