KPKB Saves Homeowners’ Deposits
In Biscayne Builders Bankruptcy
MIAMI-DADE COUNTY—Two dozen families who risked losing their pre-construction house deposits in the bankruptcy liquidation of a general contractor have now moved into their new homes, thanks in large part to the efforts of the Miami-based law firm KPKB.
Hired by the Trustee to marshal and sell assets in the reorganization of Biscayne Builders, KPKB found the company unsalvageable, and converted the case from a Chapter 11 to a Chapter 7 bankruptcy. The firm then helped the Chapter 7 Trustee find a replacement contractor, manage the construction budget, and vigorously litigated proceedings so that all outstanding construction-lien claims were paid by the Trustee.
As a result of KPKB’s efforts, not one purchaser lost any money in the South Miami-Dade Development and each purchaser was able to close free and clear of all construction liens.
