Construction disputes: Miami litigator, Andrew Gold, speaks out

MIAMI - Andrew Gold with the Litigation & Dispute Resolution Group at Florida-based law firm Kluger, Peretz, Kaplan & Berlin P.L., was a featured speaker at the Construction Defect and Mold Litigation Conference, hosted by Mealey Publications Inc., at The Ritz Carlton, Lake Las Vegas.

Gold was invited to present Mediation, Arbitration and Settlement Strategies in Mold Related Construction Disputes, covering such issues as defining the players and key legal issues for an effective settlement strategy; the benefits and burdens of arbitrating your dispute; and the key legal issues to consider when drafting and enforcing an arbitration clause.

"My primary message at the conference was that a settlement strategy must be developed in the formative stages of mold related construction disputes rather than as an ad hoc discussion," explains Gold. "This proactive approach is also stressed when I counsel clients in the construction industry on the importance of water intrusion response protocols as a way to deter mold litigation."
