Protection for ideas, names, trademarks, trade dress and business processes can invoke both a pro-active and reactive position. Proactively, Jorge helps both U.S. and Latin American businesses register their intellectual property in the United States. Also, he provides consolidated services to U.S. companies seeking registration of intellectual property abroad.

Where importing and exporting of goods is involved, Jorge advises his clients regarding U.S. Customs Law as applied to Intellectual Property Rights audits. Several key issues are mission critical and can be implemented in advance to avoid problems upon delivery. But, when a business has not had the advantage of his counsel in advance, Jorge, sometimes working with other U.S. Customs consultants, will do his best to help clients through the sometimes stressful procedure by providing swift and accurate responses.

Smelling Like a Rose: I represented a small British company that had entered into a contract to resell goods for one of the world’s largest fragrance suppliers. The supplier then breached its contractual obligations when its German affiliate began to block my client’s sales of its products. We initiated a very aggressive litigation and in a few short months were able to obtain a multi-million dollar settlement.
Supreme Praise: I represented a trade organization in an appeal to the United States Supreme Court regarding the applicability of the first-sale doctrine in copyright law to the sale of parallel-market goods. One of my arguments, although ultimately not controlling, was favorably cited by one of the justices.
Other representative cases include National and international entities including; Silknots International v. Cartel International before the Eastern District of New York, Quality King Distributors v. L'anza Research International before the U.S. Supreme Court (amicus), and Drug Emporium v. Parfums Givenchy, Inc. before the U.S. Supreme Court (amicus).
